04/29/08- H-1B Visa Holders Not The Best & Brightest!
"A report released yesterday by the nonprofit Center for Immigration Studies (CIS) posits that most of the workers hired under the H-1B visa program do not possess optimum technological skills.
Authored by University of California-Davis computer science professor Norman Matloff, the study indicated that the wages paid to technology workers who receive H-1B work visas tend to barely exceed the prevailing wages that federal law requires employers to pay these workers.
CIS also reports that most of the workers receiving the technology employment visas work either at entry level or just above it. It deduces that most of these foreign workers are not the finest in their fields and therefore do not serve as evidence that the H-1B visa program has brought many technological innovators to U.S. shores.
"In pressuring Congress to expand the H-1B work visa and employment-based green card programs, industry lobbyists have recently adopted a new tack," Mr. Matloff wrote. "Seeing that their past cries of a tech laborshortage are contradicted by stagnant or declining wages, their new buzzword is innovation."
He said that while workers from abroad may not show unique technological proficiency, one motive compels the industry to press federal officials to expand the number of visas they may utilize.
"Because they're cheap," he said. He noted two studies, both commissioned by Congress, which indicated employers admitting that they did not pay H-1B recipients as much as they paid Americans.
Ross Eisenbrey, vice president of the liberal Economic Policy Institute, said he agreed with the conclusion that those hired under work visa programs tend not to exceed their native-born counterparts in skill.
"The companies are not interested in attracting the best talent," he said. "They're really using the visa as a cost-cutting mechanism. If you wanted to get the best people, you would offer more than the average wage."
U.S. Sens. Richard Durbin (D-Ill.) and Chuck Grassley (R-IA) have introduced legislation to remove loopholes in the law allowing some employers to avoid paying the prevailing wage to H-1B workers. Their bill would also prohibit an employer from hiring someone on a work visa within 90 days of a layoff. As the country drifts into recession and U.S. workers face rising unemployment, Congress is fiddling with the idea of expanding a controversial visa program that enables employers to recruit tens of thousands of foreign workers for jobs they claim they can't fill with U.S. workers. In testimony before Congress, EPI Vice President Ross Eisenbrey makes the case that, rather than expand H-2B visas, we should scale these much-abused visas back significantly or eliminate them altogether. 04/15/08- India's Chilkur Balaji Temple - "H-1B Visa God"?
"Mohanty Dolagobinda is one of the Visa God's believers. Three years ago, a U.S. consulting company applied for a visa on his behalf. It was rejected. When the company tried again the following year, Mr. Dolagobinda's friends told him to visit the Chilkur Balaji temple ahead of his interview at the U.S. consulate. Weeks later, he sailed through the interview. "I've never heard of anyone who's gone to the temple whose visa got rejected," says Mr. Dolagobinda." 03/12/08-Sherman Oaks Lawyers Sentenced in Visa Fraud Case!
"Between 2000 and 2003, Korenberg and Rodriguez filed fraudulent employment-based visa petitions on behalf of foreign nationals seeking temporary work visas or permanent residency in the United States, according to a 33-count federal indictment.
At least 19 of the foreign nationals who benefited from the scheme were employees of the defendants' law firm, according to U.S. Immigration and Customs Enforcement officials.
Investigators said Korenberg and Rodriguez wrote false job titles and salaries on visa applications, citing jobs that didn't exist. They also lied about the foreigners' work experience." Download story in PDF format.

"My bachelor's was from a top-notch science and engineering school in California, Harvey Mudd College. I worked hard to earn a Ph.D. in biophysics at SUNYAB between 1973 and 1984. I was unable to pursue a career in radiation biophysics. Now aged 56, I have had to face the prospect of homelessness more than once because employers prefer "fresh (inexpensive) young blood" - now mostly via the controversial 1990 H-1B visa program. 02/09/08- E-Notification Coming Soon For H-1B Visa Employers
"The new e-notification system that's being developed should be online by April, when the U.S. Citizenship and Immigration Services begins accepting H-1B visa petitions for fiscal 2009, which starts on Oct. 1.
But that's not the only process change to H-1B visas that's being worked out. The Dept. of Homeland Security and Dept. of Labor are studying other administrative and regulatory "fixes" to help streamline H-1B processes, he said.

02/05/08- IBM To Open Two More Offshore Development Centers In India
"IBM announced Tuesday that it has opened another global delivery center, this one in the city of Noida, located in the northern Indian state of Uttar Pradesh, and is planning another center in the area by mid-2008. Both centers will employ about 3,000 people, IBM said. With the addition of those two, IBM will have six global delivery centers and will employ more than 70,000 people working out of facilities within some 10 cities in India." If you hire a graduate of an Indian university, it takes between 3 and 6 months for them to become productive." 01/02/08-Santa's Sweatshop: Made in D.C. with Bad Trade Policy
"Although China and inadequate U.S. safety systems are often blamed, U.S. toy corporations decisions to shift production to countries without adequate safety systems and trade policies companies pushed through Congress that limit import safety standards and inspection are the root causes of the imported toy safety crisis, according to a report released today by Public Citizen. Improving toy safety will require changes to trade policy as well as U.S. product safety policies, the report concludes."Our children's safety has been the price for soaring profits and CEO pay of major U.S. toy companies that have chosen to relocate their production to venues in which they cannot ensure the safety of their products," said Lori Wallach, director of Public Citizen's Global Trade Watch division, which produced the report. "The main villains in this unhappy holiday story are the CEOs of major U.S. toy and retail companies who spent millions lobbying to lock in race-to-the-bottom offshore production strategies with trade agreements that protect their overseas investments while limiting import safety and inspection." 12/25/07- John Bauman, H-1B Activist, Ends His Fight!
TORAW is out of funds and that its membership has shrunk to a handful of people, down from the initial wave of several hundred who signed on as members. "People lost interest in the fight," Bauman said. Many of TORAW's members have moved on, in some cases taking jobs in other industries. For instance, one of the organizers is driving an 18-wheeler, while another is doing home repair work, said Bauman, who has been focusing on TORAW's activities on a full-time basis. If there is any hint of resignation in Bauman's voice, it's not from lack of effort. In 2003 alone, lawmakers from Connecticut introduced three bills proposing changes to the H-1B and L-1 programs. TORAW also held protests, one outside of an outsourcing conference in New York. One member of the group held a sign that read: "Will Code for Food."

12/21/07- Zell Takes The Wheel At Tribune!
Reduce costs immediately. All the talk about growing revenue instead of attacking overhead is hard to swallow given the heavily leveraged structure of the buyout. Expect buyouts and layoffs. Also likely: shrinking the circulation footprint of some newspapers to save on newsprint and delivery costs and outsourcing more business functions.
Tribune newspapers already outsource circulation customer service calls to a call center in the Philippines operated by APAC Customer Service of Deerfield, Ill. Other U.S. print publications have begun farming out advertising production and basic word-processing tasks to contractors in India (See: "Dateline: Bangalore"). "Last week, the Kenyan government signed an agreement with French-US telecom group Alcatel-Lucent for a fiber-optic cable linking the Kenyan port of Mombasa with the United Arab Emirates.
More important, it will connect East Africa to the rest of the world's Internet capacity and replace the slow and costly satellite links that act as a brake on the country's fast developing industry in business process outsourcing (BPO).
At the signing, Bitange Ndemo, permanent secretary at the Ministry of Information and Communications, said the connection would allow more ordinary Kenyans to surf the Internet. Dozens of readers, some who say they are AT&T employees, commented on Network World's recent story about how the telecommunications company is requiring possibly thousands of home-based employees to give up their virtual offices and return to corporate office sites... "Others speculated that AT&T's moves could be intended to force attrition -- some teleworkers might opt to leave AT&T rather than return to an office. "Integrity is so lacking in America that the shortage myth serves the interests of universities, funding agencies, employers, and immigration attorneys at the expense of American students who naively pursue professions in which their prospects are dim. Initially it was blue-collar factory workers who were abandoned by US corporations and politicians. Now it is white-collar employees and Americans trained in science and technology. Princeton University economist Alan Blinder estimates that there are 30 to 40 million American high end service jobs that ultimately face offshoring.

It was a straightforward query about a Clinton administration trade policy that polls show the public now hates, and it was appropriately directed to a candidate who has previously praised NAFTA. 10/31/07- Bush Threatens to Veto Aid to Workers Harmed by Outsourcing!

Bush may veto legislation to expand benefits for workers harmed by international trade because it would cover more workers than necessary, a White House statement said...Specifically, the Bush administration objected to a provision that would provide added unemployment insurance and training to service workers, such as x-ray technicians or call center workers, and expand a tax break to help unemployed workers pay for health insurance...'If this bill were presented to the president in its current form, the president's senior advisers would recommend he veto the bill,' the statement said." 10/30/07- "The Science Education Myth" Analysis By: Rob Sanchez
"Vivek Wadhwa is very good at diagnosing problems and articulating them on paper. Having said that, there is not much in his article that hasn't been written many times before (see footnote below). The only difference is that Wadhwa is a CEO that happens to be a naturalized citizen from India, and he happens to write for Business Week. My guess is that the mainstream media will ignore his article because it has a little too much of the truth, and he makes enough credible points to make most corporacrats squirm. Wadhwa is somewhat of a heretic, and I'm sure he will receive wide scale condemnation in the business and Indian communities for writing the article. That doesn't mean we should embrace his positions on employment based visas, but we certainly should use what he says to bolster what we have been trying to say for years." "As Congressional Quarterly reported this week, K Street lobbying firms are now staffed up with former Democratic congressional staffers. As all of this shows, they are verifying what Leo Hindery told me in my most recent nationally syndicated newspaper column: "The wealthy are now a political constituency unto themselves that is decidedly nonpartisan."
Hindery calls it "nonpartisan" - I call it buypartisan. Whatever you want to call it, it is fueled by the very corruption we are seeing on trade, taxes and now on immigration. This is the Democratic Party of Washington, D.C. - a party that seems more and more comfortable selling out the middle-class to make corporate lobbyists happy." 10/21/07- Unfortunately Misinformed Tom Elias Column
"If Elias thinks this is all due to the Big Bad Republicans (here I
must insert the disclaimer that I am a longtime liberal Democrat), he
needs to take another look. Support of H-1B is thoroughly, and
outrageously, bipartisan. The program was created by a Republican
president with a Democratic Congress, then expanded twice by a
Democratic president with a Republican Congress. Hilary Clinton, Barak
Obama, John Edwards and other major Democratic candidates for president
have all stated that H-1B needs to be expanded, and none is willing to
admit that it is a badly abused program which is pushed by major
corporate donors to the candidates' campaign and party funds. My own
senators, Boxer and Feinstein, have been bombarded with complaints about
H-1B, yet refuse to recognize the problem, and continue to support the
program.
And though Elias is also correct that bills by Durbin (with equal
participation from Republican Grassley, whom Elias somehow "overlooked")
and Pascrell would do a good job in reforming H-1B, NONE of those
Democratic senators above have signed on as a cosponsor.
Elias is completely wrong in his claim about Tancredo and the
immigration reform organizations. Tancredo has both spoken out against
H-1B and introduced legislation to fix it. FAIR, NumbersUSA etc. have
also been quite active on the H-1B issue, as Elias would have learned if
he had simply taken 30 seconds to glance at their Web pages.
It's depressing to see a journalist with such a wide audience write such

10/21/07- Will H1-B Immigration Debacle Be Fixed?
"Sometimes writers and editorialists try to do the right thing, but they get
duped. The iditorial that is appearing in small newspapers like the Palo
Alto Daily News is a prime example.
The author appears to be a pro-labor liberal that probably intended well,
but he relied on a website with faulty information called BrightFutureJobs.
I could be giving the author too much credit for good will considering his
comments on Tom Tancredo (see more on that below).

BrightFutureJobs was founded and is directed by Donna Conroy. I'm not
totally sure what her goal or purpose is, but it has something to do with
ending discrimination against Americans -- which is definitely a worthwhile
goal. Go to the website to see if you can figure what she is all about.
Most of the webpages are sprinkled with Conroy's thoughts about how H-1B
allows discriminatory employment practices -- and she doesn't let facts get
in her way! You will also be given many opportunities to give money to the
organization -- perhaps some of that money goes to efforts at fooling
gullible journalists.
Donna Conroy sent a newsletter on behalf of BrightFutureJobs with gobs of
braggadocio about where the writer got his information for the column.
Since Conroy claims credit for the column I think it's fair game to blame
her for the results. In this case the fault may have been just as much with
the one who provided the information as with the one who wrote it.
This editorial is quite insightful. What's amazing about this
column is that he was able to glean this information from our
web site. He got every point we were making. In contrast,
some journalists are confused forever. Thomas D. Elias saw how

"The Bush administration and the Republican Party are often criticized for refusing to aggressively use the "soft power" of international diplomacy. But alas, the attacks are misguided. This crew is more than willing to use "soft power", not in Iraq, but in Central America, and not in an effort to bring American troops home, but in a ploy unfolding this weekend to enrich its big campaign contributors through the Central American Free Trade Agreement (CAFTA)." ..."Costa Rica, by contrast, was the lone nation that refused to immediately ratify the pact. The pushback was a particularly damning commentary on the deal considering that, unlike its neighbors, Costa Rica is not some war-torn quasi-colony but a longstanding democracy, "Central America's most prosperous economy and a model of social stability for the region," according to the Los Angeles Times. Opposition to CAFTA exploded from every part of Costa Rican civil society; labor unions, human rights groups, religious organizations, you name it.

Now fearing a humiliating rejection of lobbyist-written trade policy on the global stage, the White House has dispatched U.S. Ambassador Mark Langdale to spearhead a campaign of intimidation, all on the taxpayer's dime. This Texas telecommunications and real estate businessman was installed as envoy to Costa Rica after dumping tens of thousands of dollars into President Bush's political campaigns. And like the loyal corporate crony he is, Langdale has been touring Costa Rica threatening economic reprisals if voters there dare to send CAFTA down to defeat." 09/20/07- AT$T Brings Outsourced Jobs Back to U.S. !
San Antonio-based AT&T Inc. announced plans Wednesday to bring 175 call center jobs once outsourced overseas back to the United States, part of a group of 5,000 outsourced jobs company officials plan to fold back into its operations. The new call center, to be located at AT&T Arkansas' headquarters in Little Rock, will help callers who have AT&T Yahoo! High Speed Internet services. The new union-represented jobs will bring AT&T Arkansas up to 2,800 employees with a $135 million payroll, said president Ed Drilling. "These jobs are currently outsourced to other companies and a lot of the work is actually done overseas," Drilling told a news conference at the Little Rock Regional Chamber of Commerce. "The U.S.-India Political Action Committee has defended outsourcing vendors, most of whose employees are in India, although the group represents Indian-Americans. A profile of Mrs. Clinton on the group's Web site notes that "even though she was against outsourcing at the beginning of her political career, she has since changed her position." In an internal memo leaked in June, staff members from the Obama campaign contended that Mrs. Clinton's ties to wealthy Indian businesspeople had made her favor outsourcing. The memo cited the Clintons' ties to Vinod Gupta, an Indian entrepreneur who founded InfoUSA, one of the United States' largest brokers of information on consumers. Mr. Gupta, a major fund-raiser and benefactor for the Clintons who was nominated for ambassadorships by President Bill Clinton, was detailed in the Obama memo because his company outsources to India and he has vocally supported the practice." 05/13/07- From NAFTA To Iraq To The Secret Trade Deal!
"In the interest of full transparency, let's remember: It's not totally clear who has seen the actual legislative language of this deal as of now. What we do know is that while many "summaries" have been released, the actual language of the supposedly "reformed" Peru, Panama, South Korea and Colombia Free Trade Agreements have not been made public. We also know that the websites of the U.S. Trade Representative, the Senate Finance Committee and the House Ways and Means Committee only posted summaries of the deal 24 hours after the press conference, not the actual legislative language. Additionally, we know that the ongoing negotiations in pursuit of this deal were kept 100 percent concealed from rank and file members of Congress (including Congress's most veteran fair traders), reporters and the public, meaning the entire process has been shrouded in secrecy. "Ever since the offshore shift of engineering work blew up into a national issue four years ago, a question has nagged at economists and policy makers: Is outsourcing hurting America's engineering workforce? Or is it actually boosting engineering careers by making U.S. tech companies more competitive and allowing them to deploy engineers more effectively?
Duke University has been at the forefront of assessing this issue with two major research projects -- one by the Fuqua School of Business and the other by Pratt School of Engineering. What's interesting is that the two studies, both involving surveys of U.S. executives, are coming to completely different conclusions. One finds that companies are going offshore because they are desperate for talent and are shifting more complex work to nations such as India and China for strategic reasons. The other Duke study concludes that the offshoring phenomenon is all about cost and that there is no shortage of engineers in the U.S. Therefore, the labor shift is coming at the expense of U.S. jobs. 04/26/07- U.S. Negotiates Trade Agreement with South Korea
"The U.S. and South Korea agreed to terms on a trade agreement that would be the largest trade agreement since the North American Free Trade Agreement (NAFTA) was signed in the mid 1990's. Specifics are not available as the Bush United States Trade Representative (USTR) notified Congress at midnight on March 31st that they intend to sign the agreement even though the full text of the agreement doesn't exist yet. 01/27/07- Unions Split on Illegal Immigrant Workers!
The AFL-CIO, a federation of 54 unions, calls guest-worker programs exploitative and wants immigrants who enter the country to do so as permanent residents, not temporary workers. Eliseo Medina, executive vice president of SEIU, which broke from the AFL-CIO in 2005 over strategic differences, said his union recognizes "the reality of the marketplace and the economy." Anil K Joseph, Beijing, Dec 11: In an apparent bid to challenge India's dominance of the global outsourcing market, China has decided to develop 10 outsourcing base cities by 2010 to transform the Communist giant as the most favoured outsourcing destination of multinationals.

12/11/06- Illinois Job Picture? It's a Wash!
The report found 2005 median household income showed only a modest gain of $775, after a sharp decline in the early years of the decade. Even so, the gain outpaced national growth. But the state continued to lose jobs from the high-paying manufacturing sector. "Since 1990, we've been losing about 15,000 manufacturing jobs a year on average," said Paul Kleppner, one of the NIU researchers on the report. "This time around, it was only 8,900, so that's something of an improvement." The loss of jobs in the high-paying information sector continued, with 2,000 jobs lost. 12/10/06- Victory! Congress Leaves Town Without Increasing Immigration
One thing you won't have to worry about this Christmas is having to start the new year with a massive increase of H-1B visas. Despite an intense lobbying campaign by the likes of Bill Gates, Congress didn't pass an H-1B increase or any other escalation in immigration. Bill Gates started lobbying for the Skil bill months ago. He personally went to Washington D.C. twice, and an army of his paid K-Streeters swarmed Capitol Hill to buy votes. Bill Gates was so salient that the Skil Bill was nicknamed "Bill's Skil Bill". In addition Gates spent untold millions to sway Congress. Gates wasn't the only one to get slapped in the face. Hundreds of companies and dozens of think tanks, political action campaigns, and immigration lawyer groups failed to open the floodgates to cheap labor.
Congress had one last chance to slip in an increase when both the House and Senate voted in favor of the "United States-India Peaceful Atomic Energy Cooperation Act", which I call "Nukes for Mangos". The GAO found, as Commerce analysts did before them, that offshoring continues to increase in both the semiconductor and software industries.
House Science Committee Ranking Member Rep. 09/25/06- Reports, Studies Shatter Myth that H-1B Visa Holders
are Paid Same Wages as U.S. Citizens
U.S. industry spokespeople say repeatedly that H-1B visa holders are paid the same wages as similarly qualified American citizens. Numerous studies and reports, however, have found this to be untrue. Tata Consultancy Services (TCS) Vice President Phiroz Vandrevala even admitted that his company enjoys a competitive advantage because of its extensive use of foreign workers in the United States on H-1B and L-1 visas. "Our wage per employee is 20-25 percent lesser than US wage for a similar employee," Vandrevala said. "Typically, for a TCS employee with five years experience, the annual cost to the company is $60,000-70,000, while a local American employee might cost $80,000-100,000. These are trying times for U.S. labor unions. Their strength is on the wane. There are many reasons why. One reason is a fierce attack by employers and the federal government. Some of the attacks are harder to see than others. A provision in the recently passed Senate immigration reform bill expands the number of foreign nurses who may work in the U.S. Lifting this cap on immigration is the idea of Sen. Sam Brownback, a Kansas Republican, and backed by the American Hospital Association. The AHA represents hospitals, health care networks and systems. Since the 1990 federal election cycle, the AHA has spent just under $13 million, split about evenly between Democrats and Republicans, to lobby candidates, according to the Center for Responsive Politics. 08/05/06- Globalization and the American Workforce
Job losses continue in industrial sectors across the U.S. with little response from the Federal Government, noted U.S. House Science Committee Ranking Member Rep. Bart Gordon (D-TN). Gordon and fellow Committee Democrats have sought to highlight this growing problem known as offshoring in an attempt to insure hard-working Americans are kept in the loop on the state of their jobs.
Democrats efforts have centered on obtaining data compiled in 2004 by analysts at the Technology Administration (TA) within the Department of Commerce. That report, entitled An Overview of Workforce Globalization in the U.S. IT Services and Software, U.S. Semiconductor and the U.S. Pharmaceuticals Industries, provided an in-depth analysis of the ongoing loss of U.S. high-tech jobs and represents the most complete analysis to date on offshoring of U.S. jobs.
Until today, the TA analysts' report has never been publicly released. Today we are making available the executive summary and, for comparison purposes, the twelve-page "six-month assessment" the Department of Commerce released last September. 08/03/06- H-1B Exemption Cap For Fiscal Year 2007 Reached!
The following is from a Rob Sanchez Newsletter: "In November of 2004 the omnibus spending bill passed, and with it an amendment dubbed the "L-1 Visa and H-1B Visa Reform Act of 2004". The "reform" part of H-1B raised the number of visas that could be issued. International students who earn a Masters or PhD in the U.S. are now
eligible to use an H-1B visa that is exempted from the cap. Exemptions of this type have been estimated to be approximately 20,000 per year so effectively the yearly cap was raised from 65,000 to 85,000. The USCIS recently sent out a press release that all of the 20,000 exemptions were gobbled up for fiscal year 2007. The official count of 85,000 H-1Bs doesn't tell the entire story though because additional exemptions will be issued if the alien will be employed at an institution of higher education or a related or affiliated non-profit entity, or at a non-profit research organization or a governmental research organization (like Los Alamos or Lawrence Livermore labs for example). No official count has been made of the total H-1B visas that will be issued in 2007 with all exemptions included. The fact that every visa has been taken will be used as a reason to push the Skil bill along with its massive increase in the H-1B cap. Expect to see a deluge of articles in the mainstream media that use the following rationale: "The fact that employers have used all of the visas is proof that the yearly cap needs to be raised." 07/27/06- Commerce Department Report On Offshore Outsourcing Finally Sees The Light Of Day
"After nearly two years, Manufacturing & Technology News has obtained a copy of the elusive Commerce Department report on offshore outsourcing of high tech jobs in the information technology, semiconductor and pharmaceutical industries. The report, which was required by an Act of Congress, was to be submitted to Congress in July 2004. But it was never released, due to fears within the Bush administration that the controversial subject would hurt the president's re-election campaign.
